Did Sean Diddy Combs Seek Immediate Prison Release In Bail Plea? Here’s What We Know

Sean Diddy Combs is again in the news, this time as reports indicate that he wants to be let out of prison immediately while his appeal is going on. However, there is a stark contrast between what has been speculated on the internet regarding a sudden breakthrough and the actual situation, which is just a formal legal challenge filed by his attorneys in a New York federal court. 

Sean Diddy Combs Wants Out Of Prison 

Sean Diddy Combs, 56, is serving a prison sentence in New Jersey as a result of a conviction on prostitution, related charges under the Mann Act, a federal law that prohibits transporting individuals across state lines for illegal s*xual activity. In October, he was given a little over four years’ prison sentence and is supposed to stay in prison until May 2028 unless the court makes a different decision.

Sean Diddy Combs’ legal team, as per the appeal papers, is putting up a strong fight against the punishment, which they feel was too harsh. They argued that the judge at sentencing made too much of the rejected jury allegations. Although Combs was exonerated of the most serious charges, such as racketeering conspiracy and s*x trafficking, his attorneys think that the prison sentence still contains references to those parts of the indictment that were acquitted.

The appeal also questions the extent to which the judge overstepped his authority in ruling on the punishment. The defence contends that the duration of prison terms for similar cases of prostitution, related offences, is generally much shorter, particularly when force or coercion is not proven. In the case of Combs, the jury did not find any coercion, but the prison sentence was unusually lengthy.

Another significant aspect of the appeal is the reference to the testimony of Combs’ ex-partners at his sentencing. One of the witnesses, Jane,  described being forced into sexual activities during events which Combs allegedly called “hotel nights.” As a result of these assertions, only the unassociated charges were brought against Combs, which ended with a verdict of innocence, and hence, the defence argues that the prosecution should have been limited in their relevance during the sentencing.

The appeal also dwells on the trial staff’s statements made by singer Casandra “Cassie” Ventura, who informed the court of the scary past she had in a relationship with Combs. The jury was shown a video clip of the alleged attack in a hotel corridor. However, Combs’ attorneys maintain that the court should have disregarded this testimony when determining the length of the sentence, as it had nothing to do with the crimes he was convicted of.

At the moment, Combs’ lawyers want the appeals court to decide in their favour by overturning the conviction, ordering Combs’ immediate release, or remanding the case to the trial judge with the instruction to reduce the sentence. The court has not yet scheduled oral arguments. Hence, no decision will be taken immediately.
